You have the right to,
a) request information on the categories of data processed, the purposes of processing, any recipients of the data, the planned storage period (Art. 15 DSGVO);
b) request the correction of inaccurate or incomplete data (Art. 16 DSGVO);
c) to revoke a consent given at any time with effect for the future (Art. 7 para. 3 DSGVO);
d) object to data processing which is to be carried out on the basis of a legitimate interest for reasons arising from your particular situation (Art. 21 para. 1 DSGVO);
e) in certain cases within the framework of Art. 17 DSGVO to demand the deletion of data – in particular if the data are no longer required for the intended purpose or are processed unlawfully, or if you have withdrawn your consent in accordance with above (c) or have declared an objection in accordance with above (d);
f) under certain circumstances, to demand the restriction of data if deletion is not possible or the obligation to delete is in dispute (Art. 18 DSGVO);
g) data transferability, h. you can receive the data that you have provided to us in a common machine-readable format such as CSV and, if necessary, transmit it to others (Art. 20 DSGVO;)
h) complain to the responsible supervisory authority about the data processing (State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia).
Due to legal obligations, we are legally obliged in certain cases to transmit certain data to the requesting state authority.
Your data will generally be processed in Germany or other European countries. If, in exceptional cases, your data are also processed in countries outside the European Union (i.e. in so-called third countries), this will happen if you have expressly consented to this or if it is necessary for us to provide services to you or if it is legally required (Art. 49 DSGVO). In addition, your data will only be processed in third countries if certain measures have been taken to ensure that an appropriate level of data protection exists for this purpose (e.g. EU Commission adequacy decision or so-called suitable guarantees, Art. 44ff. DSGVO).
Stored data:
To be able to use the app on your device, the app must be able to access various functions and data of your terminal device. This requires that you grant certain authorizations (Art. 6 para. 1 a DSGVO). The authorization categories are programmed differently by the different manufacturers. For example, Android combines individual authorisations into authorisation categories and you can only agree to the authorisation category as a whole. Please note, however, that in the event of an objection, you may not be able to use all the functions of our app. If you have granted authorizations, we will only use them to the extent described below:
a) Registration data:
To register for the app, you do not need to enter an e-mail address. No information is stored on our servers.
b) Voice control:
The SmartConnect app provides a functionality to allow some controls via voice at home. A voice control system (e.g. Amazon Echo) is hardware for voice input and output, where voice commands are analyzed, evaluated and executed by the respective provider.
For partners, the respective provider provides an interface that allows partners to provide their own functions. This allows partners to specifically connect and use their systems with the voice control of the respective provider.
This functionality is only made available if you explicitly activate the SmartConnect skill in your account of the respective provider and link your SmartHome account with this service there (Art. 6 Para. 1 a DSGVO). Only through this link is it possible for certain commands to be evaluated by the respective provider and sent to your SmartConnect for execution. During linking, all names and IDs of your applications are transmitted to and stored by the provider in order to be able to use them in voice commands. No further data, such as account or personal data from your SmartConnect is stored or transferred to the respective provider. Please note that voice control by other persons may also occur, as different voices are not recognized.
c) Location data
The SmartConnect app does not require any information about your current location.
d) Contacts / Address Book
The SmartConnect app does not require any information from your contacts/address book.
e) WLAN connection information
The SmartConnect App requires access to the WLAN status in order to control and use your SmartConnect applications in your own home network.
f) Internet communication
The SmartConnect App requires access to the Internet via WLAN or mobile telephony in order to be able to access the control of individual applications while on the move.
g) Use of push services
The SmartConnect App also uses push services from the operating system manufacturers. These are text messages that are shown on the user’s display with his consent and actively inform the user. Conclusions on the individual user are excluded for SmartWireless.
You can deactivate the receipt of push notifications at any time in the settings of your device.
h) Miscellaneous:
The following data will be collected for the operation of the system and stored until the time of use or until you delete the data yourself.
The SmartConnect App stores the configuration data of your applications and users on the SmartConnect in your home (Art. 6 para. 1 b DSGVO).
This includes
– Current sensor and actuator states
– Configuration data for time-limited authorizations
– Events (e.g. window open, server started)
